by Avner Cohen and Lily Vaccaro, The Bulletin of Atomic Scientists, USA – The tiny Republic of the Marshall Islands recently filed an extraordinary lawsuit at the International Court of Justice in The Hague, suing all nine nuclear weapons possessors for failing to eliminate their nuclear arsenals. The legal basis of the case is derived from Article VI of the Nuclear Non-Proliferation Treaty (NPT), which obligates the five nuclear weapons states under the treaty (the United States, the Russian Federation, the United Kingdom, France, and the People’s Republic of China) “to pursue negotiations in good faith on effective measures relating to cessation of the nuclear arms race at an early date and to nuclear disarmament.”
